How to File Section 8 & 9 Affidavits

Although the filing dates for Sections 8-9 affidavits remains unchanged, the Office of Motor Vehicles has created a new form to combine both forms. The sixth year is the last year for renewal. After the sixth year, however, a new Section 8 affidavit must be filed in order to renew your license. If you haven’t filed Sections 9 and 8 affidavits yet, it is time.

A statement of use and a request for a certificate must be filed in order to file a trademark registration application under the TLTIA. These two steps must be filed within three-years of each other. Sometimes, however, an extension of the time may be required in certain cases. In these cases, the owner must file a statement stating the use of the mark and an affidavit under section 8. These filing requirements are set out in section 8 of The Trademark Act of 1986 (TTIA).

Sections 105 & 106 of the TLTIA are available.

Sections 105-206 of the TLTIA remove the requirement for continued usage in a renewal request. The trademark owner must now file a renewal application regardless of whether it is still in use. These amendments streamline the registration process for businesses. The renewal process does not require an attorney bar number. It is not necessary for an attorney to be a registered attorney for trademarks if they were a member in good standing of an association.

TLTIA amendments to section 2.45 and file section 8 require trademark owners to provide certification information and sign a declaration that the trademark has been in continuous use. The filing fee must be paid by trademark owners. Once the filing fee is paid the trademark owner can submit trademark registration applications.

TLTIA amends Lanham Act to make certain periods more lenient in allowing invalid patents to be revived. This standard now refers to "unintentional delaying", which is similar to the unavoidable delay standard for patent prosecution. Under the amended statute, this standard only applies to time required to respond to an Office Action, file a statement of use, or request an extension of time for filing a statement of use.

You must renew your registration at least every six years to comply with TLTIA. The renewal process is not automatic and you will need to prove that the mark has been used continuously. There are several ways to initiate the renewal process. These are some suggestions for renewing your registration. Keep in mind that you have to use the renewal form on the same day as the expiration date. Both you and the trademark attorney must sign your renewal application.

TLTIA 9 incontestability

One of TLTIA's most important changes is the elimination or modification of the requirement to have a registered party sign the application. Although TLTIA eliminates the need for a proper party to sign, it still requires an owner to file an application for registration, amend his or her allegation of use, statement of use, or request for an extension of time to file a statement of use. A section 8 affidavit, required by the Act, must be filed every ten years.

You must ensure that your trademark has been in use in the United States at least three years before applying for TLTIA Section 15 incontestable status. At least three years must pass since the trademark's first use. Not the alleged violator, the trademark owner should file theaffidavits incontestability.
